Sales terms and conditions
1. Validity of the Sales Terms
1.1 These Sales Terms and Conditions apply to the rights and obligations arising from the purchase of products between the customers of the Hampona OÜ online store (hereinafter referred to as the “Store”) (hereinafter referred to as the “Buyer”) and Hampona OÜ.
1.2 The owner of the Store is Hampona OÜ, Registry code: 17214946, VAT nr: EE102874286, Address: Kuuseheki 66, Saue, Estonia, 76506, Phone: +372 59011556, Email: info@hampona.com.
1.3 These Sales Terms and Conditions apply to all purchases made in the Store.
2. Prices and Payment
2.1 All prices of products sold in the Store are displayed in euros and include value added tax (VAT), as Hampona OÜ is a registered VAT payer.
2.2 Delivery costs are not included in the product price and will be added to the shopping cart according to the selected delivery method.
2.3 Information about products is provided next to each respective product in the Store.
2.4 The Buyer may pay for the products using the following methods:
- via bank link payments,
- by bank transfer based on an invoice,
- by credit card via Apple Pay and Google Pay.
2.5 For bank link and card payments, the Buyer is redirected to a secure payment environment (e.g. EveryPay). Hampona OÜ does not have access to and does not store the Buyer’s card details.
2.6 When paying based on an invoice, the invoice will be sent to the Buyer by email.
3. Order Placement and Fulfillment
3.1 To place an order, the Buyer must add the desired products to the shopping cart, fill in the required details, and confirm the order. The Buyer may then choose a suitable payment method.
3.2 The sales contract enters into force once the payment for the order has been received in the bank account of Hampona OÜ.
3.3 Products are dispatched after the payment has been received.
3.4 Parcels are delivered to the Buyer via Omniva parcel lockers.
3.5 Within Estonia, deliveries generally reach the Buyer within 1–4 business days from the receipt of payment. Delivery to other countries may take longer depending on the destination.
3.6 If it is not possible to deliver the ordered product (e.g. the product is out of stock), the Buyer will be informed as soon as possible and the paid amount will be refunded without delay, but no later than within 14 days.
4. Returns and Right of Withdrawal
4.1 The Buyer has the right to return products purchased from the Store within 14 days from the receipt of the products. The right of withdrawal does not apply if the Buyer is a legal entity.
4.2 To return a product, a withdrawal notice must be submitted by email to info@hampona.com no later than within 14 days from receiving the products.
4.3 The costs of returning the products are borne by the Buyer, unless the returned product does not correspond to the order or is defective.
4.4 Returned products must be unused, in original packaging, and undamaged.
4.5 The right of withdrawal does not apply if:
- the product has been damaged due to the Buyer’s fault (e.g. dropping, mechanical damage),
- the damage is due to normal wear and tear that does not significantly affect the product’s usability.
4.6 Upon receipt of the returned products, the Store will refund all paid amounts to the Buyer no later than within 14 days.
4.7 The refund will be made using the same payment method that was used for the original transaction.
4.8 The Store may refuse to issue a refund until the returned goods have been received or until proof of return shipment has been provided.
4.9 The Store reserves the right to withdraw from the sales contract if the product price has been mistakenly displayed significantly below the market price.
5. Product Care and Use
- All products sold in the Store are intended for hand washing only.
- Products must not be washed in a dishwasher, as this may damage the appearance, material, or functionality of the products.
- The Store is not responsible for defects or damage resulting from improper use or care of the products, including but not limited to washing the products in a dishwasher.
6. Right to Submit Claims
6.1 The Store is liable for any non-conformity of the products with the contract terms that existed at the time of delivery and becomes apparent within two years from the receipt of the products.
6.2 In case of a defect, the Buyer must contact the Store no later than within two months by email at info@hampona.com.
6.3 The claim must include:
- the Buyer’s name and contact details,
- the order number and date,
- a description of the defect,
- the Buyer’s claim.
6.4 The Store is not liable for defects that have arisen after the products were delivered to the Buyer.
6.5 If the defect falls under the Store’s responsibility, the Store will repair or replace the product. If this is not possible, the full purchase price will be refunded to the Buyer.
6.6 The Store will respond to the claim within 15 days in writing or in a form that can be reproduced in writing.
7. Dispute Resolution
7.1 If the Buyer and the Store are unable to resolve the dispute by mutual agreement, the Buyer has the right to turn to the Consumer Disputes Committee.
